Please read this policy carefully and make sure that you understand and agree with it before providing us with your personal data. If you do not agree, please do not use this website or its services, nor provide us with your data. By accessing this site, using any of its services or providing us with your data, whether online or offline, we will understand it as a clear affirmative action by which you give us your consent (when required) to process your data for the purposes indicated below.
2. WHO IS RESPONSIBLE FOR PROCESSING YOUR DATA?
BH BIKES EUROPE, S.L.
Postal address: C/ Perretagana 10, 01015 VITORIA
Email: rgpd@bhbikes.com
Phone: 945142700
3. HOW HAVE WE OBTAINED YOUR DATA?
Data obtained directly from the data subject:
If you are a current or potential customer, or merely a user of our website, you have provided your data to us, either offline or online, when requesting our services in order to maintain a contractual relationship with you, or by contacting us to request information, or, for example, if you have visited our offices or plant, you have provided your data upon accessing our facilities as a visitor. Likewise, your data may have been communicated to us, where applicable, by our commercial network after you provided your data to one of our sales representatives.
The categories of data we process are: identification data; postal or electronic addresses; commercial information; and financial data. We do not process any special categories of data.
This information includes, for example:
– Your contact details, including your first and last name, address (billing or delivery), date of birth, and email address, and optionally your telephone number. We need your email address and (optionally) your telephone number in order to contact you if we have questions or information about your order;
– Other information necessary to process your order, such as information about the products you have ordered, your billing and delivery addresses, and your bank or credit card details;
– If you have created an online profile, the preferences and interests stored in that profile;
– If you have contacted customer service, the details and history of that contact;
– If, to participate in any event, activity, promotion, or contest organized by us, you send us a video, photographs, or any other type of text or audiovisual content (articles, drawings, etc.) protected by industrial or intellectual property rights, sending such content implies the sender’s authorization for its use by BH BIKES on this website — and therefore its availability to third parties — as well as on our profiles on any social networks and on YouTube, to inform about the event/activity, document it, and form part of its photographic/videographic record, as well as in advertising brochures, posters, stationery, and promotional materials, etc.
Therefore, you grant BH BIKES, on a non-exclusive, worldwide, royalty-free, unlimited-duration basis, a sublicensable right to reproduce, distribute, translate, publish, and disclose such content, in whole or in part, by any means currently known or developed in the future, for any purpose.
The ownership of the copyright of such content belongs to its author, who guarantees such ownership. Nevertheless, by sending or uploading such content to this website or to our social media profiles, you assign to BH BIKES the rights of reproduction and public communication over said content, while retaining your right to exploit it in any manner that does not affect the normal publication of the content through the aforementioned means.
– The sender guarantees ownership or that they hold all necessary rights, capacity, and/or permissions to license such content, and that it does not infringe any third-party rights, including any industrial or intellectual property rights. The sender is responsible for obtaining all necessary authorizations, whether public or private, and for making all required payments for the use of any intellectual or industrial property rights.
The sender shall be solely responsible for any claims that may be made by third parties, including public authorities, regarding the content and ownership of such materials, as well as for any damages that may be caused to BH BIKES EUROPE, which is expressly empowered to take any legal actions available for the protection of its rights.
When you provide us with your personal data, you guarantee that you are authorized to do so and that such information is true, accurate, and up to date, that it is not confidential, that it does not violate any contractual restrictions or third-party rights, and you agree not to impersonate other users.
Automatic collection when visiting our website
If you have provided your data through this website, we collect information, for example, when you access the page, when you register as a user, fill out any form with personal data, or when you communicate with us directly by email.
When you visit our website, data is sent from your browser to our server in order to optimize our services and improve your user experience — for example, when you access the page or when you log in to our Services through third-party services such as social networks or Google. This data may be collected and stored automatically by us or by third parties on our behalf. Such data may include:
– the user’s IP address
– the date and time of the visit
– the URL of the site from which the user comes
– the pages visited on our website
– information about the browser used (type and version of browser, operating system, etc.)
We may process and record such usage, sessions, and related information, either independently or with the assistance of third-party services, including through the use of “cookies” and other tracking technologies such as flash cookies and web analytics.
In relation to the above, we offer location-based services in some of our mobile applications, such as Google Maps and Bing Maps. If you use these mobile applications, they may receive information about your actual location (for example, GPS signals sent by a mobile device) or information that can be used to approximate your location. Generally, you can enable or disable location services in your device or browser settings.
We use Google Maps or Bing Maps services to help you find the nearest BH Bikes store. To facilitate this process, we load a Google Maps or Bing Maps image and store the route data and map image on our server.
For more information about Google Maps and Bing Maps and their Privacy Policies, please consult their respective privacy policies.
Our website and mobile application use Internet retargeting technology. We believe that displaying personalized advertising, based on the user’s interests, is more engaging for our customers than non-personalized advertising, and this technology allows us to show our visitors—who have already shown interest in our store and products—our ads on third-party websites. To do so, we work with companies that use tracking technologies to display advertisements on our behalf on the Internet. These companies may collect information about your visits to our website or mobile applications and your interactions with our communications, including advertising.
Retargeting technologies analyze your cookies and display advertising based on your browsing behavior, but we do not store your personal data with this technology, and it complies with applicable Data Protection requirements.
Our website contains connectors to social networks. When you choose to interact with us through a social network, we cannot be held responsible for the privacy settings chosen by the user. The social network may inform about your IP address or which page you are visiting on our website and may set a cookie to allow it to function properly. For example, your name may appear in the “likes” you give or in the comments you post on our page in a social network. If you do not want your personal data to appear associated with such “likes” or comments, configure your privacy settings to prevent it, for example by pseudonymizing your data (using a nickname or alias that does not reveal your full name).
If you log into one of these social networks during your visit to our website, the social network may add that information to your profile, and that information will be transferred to the social network. If you do not want this transfer of data to occur, log out of your social network account before entering our websites or mobile applications, as we cannot influence this collection and transfer of data through social connectors.
If the user, through our official social network page, decides to publish and/or share texts, photos, videos, or other types of information and/or content, they will be solely responsible for ensuring that such content complies with the relevant legal regulations. We remind you that regarding the data of other persons, you must respect their privacy, taking special care when communicating or publishing their personal data. Only the data subject may authorize the processing of their personal data.
The user may only publish on this page, or on our official social media pages, personal data, photographs, information, or other content that belong to them or for which they have obtained authorization from third parties. If you provide or publish data belonging to third parties, it is your responsibility to have their prior and express consent to use, communicate, and publish them, and it is also your responsibility to inform them about the processing of their data by us or their publication by you. Publishing data of third parties without their consent may infringe, in addition to data protection laws, the rights to honor, privacy, or image of such third parties.
In any case, we may delete from this website and our social media pages any content published by the user if we detect that the user has violated applicable law or the provisions of this Privacy Policy.
Social networks are not hosted directly on our Services. Your interactions with them are governed by their own policies, not ours. Please read the privacy policies of these social networks for detailed information about the collection and transfer of personal data, your rights, and how to configure your privacy settings.
Data provided by a third party:
In cases where the data is not provided by the data subject but by a third party, your data may have been communicated to us, if applicable, by our commercial network or distributors after having been provided to one of our sales representatives.
In such cases, the categories of data we process may include: identifying, economic, financial, and insurance data, and data related to goods and services transactions.
If you request financing for purchased items, the financing entity may inform us whether the requested financing has been granted or not.
4. THIRD-PARTY DATA
Regarding the data of other people, you must respect their privacy and exercise special care when publishing their personal data. Please note that, as a user, you may only provide and consent to the processing of your own personal data, not that of third parties. If you provide us with third-party data, you are making a transfer of personal data, and it is your responsibility to obtain the prior and express consent of those third parties to use and provide their data to us. You are also responsible for informing them of the inclusion of their data in our files.
Publishing third-party data without their consent may violate, in addition to data protection regulations, the rights to honor, privacy, or image of such third parties, rights protected under Organic Law 1/1982, of May 5th, on civil protection of the right to honor, personal and family privacy, and image.
5. DATA OF MINORS
Providing data on this website by individuals under 14 years of age is not allowed. If you are under this age, we will require your parents or legal guardians to give permission for you to provide your data. Minors under 14 may register on this website only with the authorization and consent of their parents, guardians, or legal representatives, who will be solely responsible for all actions carried out through this website by the minors under their care, including completing forms with the personal data of such minors and, if applicable, ticking the corresponding boxes. Parents, guardians, or legal representatives must enable the necessary mechanisms to prevent minors under their care from accessing this website and/or providing personal data without supervision; this organization assumes no responsibility in this regard.
If it is detected that a minor under 14 has registered without authorization, the parents or guardians may be requested to provide the appropriate documents to verify such authorization. Otherwise, the user or registration will be deleted as soon as possible.
If parents, guardians, or legal representatives of minors detect unauthorized data processing, they may submit claims or inquiries by contacting: rgpd@bhbikes.com
6. PURPOSE | WHAT DO WE PROCESS YOUR DATA FOR?
We may process the data for different purposes, for example:
a)If you are a current or potential customer, to maintain contact and communication with you, manage the contractual and/or commercial relationship, including after-sales and warranty services, and handle any requests you make online and, where applicable, your invitation, registration and/or participation in activities or events promoted or organized by BH BIKES. You are also informed that during such events and activities, photographs and/or videos may be taken and published on this website, on our social media profiles, as well as on YouTube, to inform about the event/activity, document it, and form part of its photographic/videographic record.
b)If you are merely a user of our website or the sender/recipient of an email, to maintain contact and communication with you and manage the online requests you make.
c)To offer, develop, personalize, and improve our products and services according to your interests and enhance your user experience, we will create a "commercial profile" based on the information provided. Automated decisions will be made based on this profile, applying criteria such as your geolocation to indicate purchase prices in your country or to direct you to the store closest to you, your purchases in our online and/or physical BH Bikes stores, your use of loyalty programs, your product ratings and reviews, your history of contacts with our customer service department, your newsletter open and click results, your browsing behavior (web tracking), the types of newsletters you subscribe to, your participation in promotions or events, your interactions with "My Coach" and your use of our mobile applications.
To assess your creditworthiness, you authorize BH Bikes to consult third parties such as financial institutions, credit reporting and solvency companies, etc., to request additional economic and financial data necessary to complete information about your solvency.
d)If you provide your curriculum data or send us your CV, to contact you and manage recruitment processes we carry out.
e)If you access our facilities as a visitor, to manage access and visitor control.
f)To conduct opinion and/or satisfaction surveys and send you, via electronic communications, information about our activities, products and/or services similar to those requested (including advertising and/or commercial communications under Article 21 of Law 34/2002, LSSICE). If we already have a prior contractual relationship, such communications will be sent based on our legitimate interest. If no such relationship exists, we will only send you this type of communication if you expressly authorize it by ticking the corresponding box on the relevant forms. The electronic communications we send will include an option to unsubscribe. If you choose to do so, we will stop sending such communications in the future.
7. RETENTION PERIOD | HOW LONG WILL WE KEEP YOUR DATA?
The personal data you provide will be kept as long as you do not request their deletion.
Even if you request deletion, we may retain them for the time necessary — with processing limited only — to comply with the legal/contractual obligations to which we are subject, and/or for the legal periods established for the prescription of any liabilities on our part and/or for the exercise or defense of claims arising from the relationship maintained with the data subject.
8. LEGAL BASIS | WHAT IS THE LEGAL BASIS FOR PROCESSING YOUR DATA?
The legal basis that legitimizes us to process your data may vary:
On one hand, it may derive from the legal relationship that binds us if you are a current customer/supplier, or from the pre-contractual relationship existing between the parties if you are a potential customer/supplier (for example, if you have requested information, a quotation, or an estimate).
The provision of the requested data is mandatory because it is essential to formalize and/or maintain the contractual or pre-contractual relationship and to comply with the legal obligations arising from it; if you do not provide them, we will not be able to provide the service derived from such relationship.
It may also be based on your consent, if you have submitted a request through our website as a user, or if you have sent us your résumé, or if you are a visitor to our facilities, or in the case of image capture.
Such consent is given unequivocally when you provide your data online or offline, and such provision is considered a clear affirmative act expressing that consent.
You may withdraw that consent at any time by sending us an email to rgpd@bhbikes.com, but such withdrawal may mean that we cannot respond to your request, take your résumé into account, or grant you access to our facilities.
It may also derive from compliance with legal obligations, such as those related to consumer and user protection, anti–money laundering, tax obligations, or the Criminal Code regarding the establishment of a whistleblowing channel under Article 31 bis of said code.
Likewise, our legitimate interest as an organization constitutes a legal basis for processing your data, for example:
– To conduct opinion and/or satisfaction surveys.
– To inform you about our activities, products and/or services (including electronic communications).
If we already have a prior contractual relationship, such communications will be sent on the basis of our legitimate interest. Otherwise, we will only send such communications if you give us your consent by checking the option expressly included for that purpose in the relevant forms.
In any case, the electronic communications we send will include an option to unsubscribe from future messages.
9. RECIPIENTS | TO WHICH RECIPIENTS MAY WE COMMUNICATE YOUR DATA?
We inform you that the data you provide may be communicated to third-party entities for the fulfillment of purposes directly related to the legitimate functions of the assignor and assignee, such as:
- To transport companies responsible for the logistics of shipping and delivering our goods.
- To other companies within the BH corporate group for internal administrative purposes, including the processing of customers’ personal data.
- To stores or distributors for the assembly and delivery of the purchased bicycle.
- To entities or organizations to which there is a legal obligation to report data (e.g., tax authorities…).
- To the various entities that, at any given time, are necessary to provide the different payment services and manage the collections and payments made through this website, as well as the obligations arising from the payment systems that facilitate them; all in compliance with the functions that these entities must perform to provide such services.
- To insurance entities in the case of credit and surety insurance to secure the collection of transactions or to insure civil liability or defective products in the event of possible claims by the end user.
- To our subsidiaries in other countries, or to the agents or distributors in our commercial network, we will communicate inquiries received through our website that must be handled by them. In the event that this involves an international transfer of data to a country outside the European Economic Area, the data subject gives unequivocal consent to such transfer by providing their data.
International Transfers
We may use service providers located outside the European Union who may have access to personal data in order to provide auxiliary services to our business (hosting, housing, SaaS, remote backups, IT support or maintenance services, email management, sending emails and email marketing, file transfers, etc.).
These companies may vary over time, but in any case, we will select companies that provide an adequate level of protection, meaning they are obligated to comply with requirements equivalent to European data protection standards.
In any case, by accepting this data protection policy, you expressly and unequivocally authorize the communication of your data to these companies, acknowledging that this implies an international data transfer to a country outside the European Economic Area and giving your unequivocal consent to such transfer.
10. WHAT ARE YOUR RIGHTS WHEN YOU PROVIDE US WITH YOUR DATA?
You may, where applicable, exercise your rights of access, rectification, deletion, restriction, and objection to the processing of your data, as well as not to be subject to decisions based solely on automated processing of your data,
at the postal or email address indicated at the beginning of this privacy policy; in both cases through a written and signed request, attaching a copy of your ID card, passport, or other valid identification document. In case of modification of your data, you must notify us at the same address, this company disclaiming any responsibility if you fail to do so.
Right of access:You may ask us which personal data we are processing and request a copy of it.
Right of rectification:You may request the correction of inaccurate personal data or the completion of incomplete data, including through an additional statement.
Right of deletion (right to be forgotten):You may request the deletion of your personal data when: they are no longer necessary for the purposes for which they were collected, you withdraw your consent, there has been unlawful processing, or to comply with a legal obligation.
Right to restrict processing:You may request the restriction of the processing of your data, in which case we will only retain it for the exercise or defense of claims.
Right to object:You may object to the processing of your data if such processing is based on the legitimate interest of the data controller or for advertising purposes.
Once any of the above requests are received, we will respond within the legally established deadlines. You may lodge a complaint with the Spanish Data Protection Agency. For more information about the rights you may exercise and to request forms to exercise these rights, you may visit the website of the Spanish Data Protection Agency, www.aepd.es.
11. CATEGORIES OF DATA
The categories of data we process are: identification data; professional data; economic and financial data; transactions of goods and services.
