3. HOW DID WE OBTAIN YOUR DATA?
Obtained directly from the data subject: If you are a current or potential customer, or simply a user of our website, you have provided it to us, either offline or online, by requesting our services to maintain the contractual relationship with you, contacting us for information, or, for example, visiting our offices or plant as a visitor. Likewise, your data may have been communicated to us by our sales network after providing your data to one of our sales representatives. The categories of data we process are: identification data; postal or electronic addresses; commercial information and financial data. We do not process special categories of data.
This information includes, for example:
Your contact data, including your name and surname, address (billing or delivery), date of birth, and email address, and optionally your phone number. We need your email address and, optionally, your phone number to contact you if we have questions or information about your order;
Other information necessary to process your order, such as information about the products you have ordered, billing and delivery addresses, and bank or credit card details;
If you have created an online profile, the preferences and interests stored in that profile;
If you have contacted customer service, the details and history of that contact;
If, to participate in any event, activity, promotion, or contest organized by us, you send us a video, photographs, or any other type of text or audiovisual content (articles, drawings, etc.) protected by industrial or intellectual property rights, submitting such content constitutes authorization from the sender for its use by BH BIKES on this website, and therefore making it available to third parties, as well as on our profiles on any social networks, including YouTube, to inform about the event/activity, document it, and be part of its photographic/video record, as well as in promotional brochures, posters, stationery, and marketing materials. Therefore, you grant BH BIKES a non-exclusive, free, unlimited-duration, worldwide, sublicensable right to reproduce, distribute, translate, publish, and disseminate said content in whole or in part in any media currently known or developed in the future, for any purpose. The copyright of such content belongs to the author, who guarantees it. However, submitting or uploading content to this website or our social networks constitutes the assignment of reproduction and public communication rights over said content, while the author retains the right to exploit it in any manner that does not affect its normal publication as described above.
The sender guarantees ownership or that they have all necessary rights, capacities, and/or permissions to license said content, and that it does not infringe any third-party rights, including industrial or intellectual property rights, being responsible for obtaining all necessary public or private authorizations and making all payments for the rights to use intellectual and industrial property. The sender shall be solely responsible for claims made by third parties, including public authorities, regarding the content and ownership of said content, as well as for any damages caused to BH BIKES EUROPE, which is expressly authorized to take legal action to defend its rights.
When you provide us with your personal data, you guarantee that you are authorized to provide this information and that it is true, accurate, up-to-date, not confidential, does not violate any contractual restrictions or third-party rights, and you agree not to impersonate other users.
Automatically obtained when visiting our website: If you provided data through this website, we collect information, for example, when you access the page, register as a user, fill out any form with personal data, or communicate with us directly by email.
When you visit our website, data is sent from your browser to our server to optimize our services and improve your user experience, for example, when accessing the page or logging into our services through third-party services like social networks or Google. This data may be collected and stored automatically by us or by third parties on our behalf. This data may include:
User IP address
Date and time of the visit
URL of the site from which the user came
Pages visited on our website
Browser information (type and version, operating system, etc.)
We may process and record such usage, sessions, and related information independently or with the help of third-party services, including using cookies and other tracking technologies such as flash cookies and web analytics.
Regarding the above, we offer location services in some of our mobile applications, such as Google Maps and Bing Maps. If you use these mobile applications, they may receive information about your real location (such as GPS signals sent by a mobile device) or information that can be used to approximate your location. Generally, you can enable or disable location services on your device or browser settings.
We use Google Maps or Bing Maps to help you find the nearest BH Bikes store. To facilitate this process, we load an image from Google Maps or Bing Maps and store the route data and map image on our server.
For more information about Google Maps and Bing Maps and their Privacy Policy, consult their privacy policies.
Our website and mobile application use Internet retargeting technology. We consider that displaying personalized advertising based on the user's interests is more relevant to our clients than advertising with no personal connection, and this technology allows us to show visitors, who were already interested in our store and products, our advertisements on other third-party websites. For this, we work with companies that use tracking technologies to display ads on our behalf online. These companies may collect information about your visits to our website or mobile applications and your interaction with our communications, including advertising.
Retargeting technologies analyze your cookies and display ads based on your browsing behavior, but we do not store your personal data with this technology, and it complies with applicable data protection requirements.
Our website has connectors to social networks. When you choose to interact with us through a social network, we cannot be responsible for the privacy settings chosen by the user. The social network may report your IP address or which page you are visiting on our website and may set a cookie to function properly, or, for example, your name may appear in "likes" or comments you make on our social network page. If you do not want personal data associated with these "likes" or comments to appear, configure your privacy settings, e.g., by using a nickname or alias that does not reveal your name and surname.
If you log into one of these social networks during your visit to our website, the social network may add that information to your profile, and that information will be transferred to the social network. If you do not want this data transfer to occur, log out of the social network before entering our websites or mobile applications, as we cannot influence this collection and transfer of data through social connectors.
If the user, through our official page on a social network, decides to publish and/or share texts, photos, videos, and other information and/or content, they will be solely responsible for ensuring that such content complies with applicable law. Regarding other people's data, you must respect their privacy, especially when communicating or publishing their personal data. Only the owner may authorize the processing of their personal data. Users may only publish on this page, or our official social network page, personal data, photographs, and information or other content that they own or have permission from third parties. If you provide or publish third-party data, you are responsible for obtaining prior and express consent to use, communicate, and publish it and informing them about its processing by us or its publication by you. Publishing third-party data without consent may violate, in addition to data protection regulations, rights to honor, privacy, or image.
In any case, we may delete from this website or our social network pages any content posted by the user when we detect that the user has violated current legislation and the provisions of this privacy policy.
Social networks are not hosted directly on our Services. Your interactions with them are governed by their policies and not ours. Read the privacy policies of those social networks for detailed information about data collection and transfer, your rights, and privacy settings.
Communication by a third party of the data of the data subject: If a third party, rather than the data subject, provides data, your data may have been communicated to us by our commercial network or distributors after providing your data to one of our sales representatives.
In this case, the categories of data we process may include identification, economic, financial, insurance, and transaction data.
If you request financing for purchased items, the financing entity may inform us whether the financing you requested has been granted.
4. THIRD-PARTY DATA
Regarding the data of other people, you must respect their privacy, taking special care when publishing their personal data. As a user, you may only provide and consent to the processing of your own personal data, not that of third parties. If you provide us with third-party data, you are making a transfer of personal data, and it is your responsibility to obtain prior and express consent from those third parties to use and provide their data to us, and to inform them of its inclusion in our files.
Publishing third-party data without consent may violate, in addition to data protection regulations, the right to honor, privacy, or personal image of those third parties. The protection of these rights is governed by the provisions of Organic Law 1/1982, of May 5, on civil protection of the right to honor, personal and family privacy, and one’s own image.
5. DATA OF MINORS
Providing data on this website by minors under 14 years old is not permitted. If you are under this age, we will require permission from your parents or guardians to provide us with your data. Minors under 14 may register on this website only with the authorization and consent of their parents, guardians, or legal representatives, who will be solely responsible for all actions performed on this website by minors under their care, including completing forms with the minors’ personal data and checking any boxes associated with them. Parents, guardians, or legal representatives must enable the necessary mechanisms to prevent minors under their care from accessing this website and/or providing personal data without supervision; this organization assumes no responsibility in this regard.
If a minor under 14 is found to have registered without authorization, documentation proving such authorization may be requested from their parents or guardians. Otherwise, the user account or registration will be deleted as soon as possible.
Parents, guardians, or legal representatives who detect unauthorized processing of minors’ data may submit complaints or inquiries to: rgpd@bhbikes.com
6. PURPOSE | WHY WE PROCESS YOUR DATA
We may process your data for various purposes, for example:
a) If you are a current or potential customer, to maintain contact and communication with you, manage the contractual and/or commercial relationship, including after-sales and warranty services, and handle requests made online, as well as your invitation, registration, and/or participation in activities or events promoted or organized by BH BIKES. Events and activities may be photographed and/or recorded on video, which may be published on this website, our profiles on any social networks, or YouTube to inform about the event/activity, document it, and form part of its photographic/video record.
b) If you are a mere user of our website or the sender/recipient of an email, to maintain contact and communication with you and handle requests made online;
c) To offer, develop, personalize, and improve our products and services according to your interests and improve your user experience, we will create a “commercial profile” based on the information provided. Automated decisions may be made based on this profile, applying criteria such as geolocation to indicate purchase prices for your country or direct you to the nearest store, your purchases in our online or physical BH Bikes stores, your use of loyalty programs, product ratings and reviews, your contact history with our customer service, your newsletter opens and clicks, browsing behavior (web tracking), types of newsletters subscribed, participation in promotions or events, interactions with “My Coach,” and use of our mobile applications. To assess your solvency, you authorize BH Bikes to consult third parties such as financial institutions or credit and solvency reporting companies for additional financial information needed.
d) If you provide us with your CV or send your curriculum, to contact you and manage recruitment processes we carry out;
e) If you access our facilities as a visitor, to manage access and control visits;
f) To conduct surveys and/or satisfaction polls and send you, via electronic communications, information about our activities, products, and/or services similar to those requested (including advertising and/or commercial communications under Article 21 of LSSICE 34/2002). If we already have a prior contractual relationship, such communications will be sent based on our legitimate interest. Otherwise, such communications will only be sent with your consent, explicitly granted via the corresponding form. Electronic communications will include an option to unsubscribe.
7. RETENTION PERIOD | HOW LONG WE KEEP YOUR DATA
Personal data you provide will be kept until you request its deletion. Even after such a request, we may retain data as necessary, limiting processing solely to comply with legal/contractual obligations and/or for the statutory periods for any claims and/or the exercise or defense of claims arising from the relationship with the data subject.
8. LEGAL BASIS | WHAT LEGITIMIZES THE PROCESSING OF YOUR DATA
The legal basis for processing your data may be diverse:
The legal relationship with you if you are a current client/supplier, or the pre-contractual relationship if you are a potential client/supplier (e.g., if you requested information, an offer, or a quote). Providing requested data is mandatory to formalize and/or maintain the contractual or pre-contractual relationship and fulfill legal obligations; otherwise, we cannot provide the service derived from that relationship.
Your consent if you made a request via our website as a mere user, sent your CV, visited our facilities, or submitted images. This consent is given unequivocally by providing data online or offline, considered a clear affirmative act. You may withdraw consent at any time by emailing rgpd@bhbikes.com
, but withdrawal may prevent us from responding to requests, considering your CV, or granting access to facilities.
Compliance with consumer and user regulations, anti-money laundering, tax regulations, or the criminal code regarding whistleblower channels (Article 31 bis).
Our legitimate interest as an organization to conduct surveys, inform about our activities, products, or services (including electronic communications). Communications will include the option to unsubscribe.
9. Recipients | To whom your data may be communicated
Your data may be communicated to third parties to fulfill functions directly related to legitimate purposes of the assignor and assignee, such as:
Transport companies responsible for logistics, shipping, and delivery of goods;
Other companies in the BH group for internal administrative purposes, including processing customer data;
Stores or distributors for assembly and delivery of the purchased bicycle;
Entities or organizations legally required to receive data communications (tax authorities, etc.);

Our subsidiaries in other countries, or agents/distributors in our commercial network, for handling web inquiries. International data transfers may occur, and the data subject provides unequivocal consent for such transfers outside the European Economic Area.
International Transfers
We may use service providers outside the EU that have access to personal data to provide auxiliary services (hosting, SaaS, remote backups, IT support, email services, marketing, file transfers, etc.). These providers may vary over time, but we will choose companies that offer an adequate level of protection equivalent to European standards. By accepting this privacy policy, you expressly authorize communication of data to such companies, acknowledging potential international transfers outside the EEA.
10. YOUR RIGHTS WHEN PROVIDING DATA
You may exercise, when applicable, your rights of access, rectification, deletion, limitation, objection to processing, and to not be subject to decisions based solely on automated processing of your data.
Requests should be made in writing with a copy of ID, passport, or other valid identification to the postal or email addresses indicated at the beginning of this policy. Changes to your data should be communicated to the same address.

Right to limit processing: Data is retained only to exercise or defend claims.
Right to object: Object to processing based on legitimate interest or for advertising purposes.
We will respond within legally established deadlines. Complaints may be filed with the Spanish Data Protection Agency (www.aepd.es).
